How to Request Access to Records
A request for access to a record must be made on the prescribed form, Form 2 of the PAIA Regulations, which is available from the Information Officer or from the website of the Information Regulator.
The request must be directed to the Information Officer and must be delivered:
by hand to The Pivot, Block A, 2nd Floor, 1 Monte Casino Boulevard, Fourways, Sandton, Johannesburg, 2091; or
by email to contact@notel.co.za; or
by prepaid registered post to [Insert Postal Address].
The request must include sufficient particulars to enable the Information Officer to identify:
the record or records requested;
the identity of the requester;
the form of access required;
the capacity of the requester to exercise the right; and
the address and contact details of the requester.
The prescribed request fee, as determined by regulation from time to time, must accompany the request where applicable.
If a requester cannot read or write, or is disabled, they may make the request orally, and the Information Officer will reduce the request to writing on the prescribed form.
Prescribed Fees
The fees applicable to requests for access to records are prescribed in Part II of the PAIA Regulations and are subject to change. The fees include:
a request fee, payable on submission of a request;
an access fee, payable before access is granted, calculated based on the form of access and the volume of records required;
a fee for searching for and preparing records for disclosure, where applicable;
copying and postage fees; and
a fee for time reasonably spent in searching for and preparing the record.
A full fee schedule is available from the Information Officer on request. Where a requester falls within a category of persons exempt from paying fees (for example, where the request is made by a person who is granted access in the public interest, or where the requester cannot afford to pay), the Information Officer will consider a fee waiver application.
Handling of a Request
The Information Officer will acknowledge receipt of the request within five business days of receiving it.
The Information Officer will, within 30 days of receiving the request (or such extended period as may be permitted by PAIA), decide whether to grant or refuse the request, and will notify the requester in writing of the decision.
Where the request is granted, the notification will state the form in which access will be given, the amount of any access fee payable, and any other relevant particulars.
Where the request is refused, the notification will state the grounds of refusal, and will inform the requester of their right to lodge a complaint with the Information Regulator or to apply to a court for relief.
The Information Officer may extend the period for responding to a request in certain circumstances, including where the request relates to a large volume of records, where the records are held off-site, or where consultation with a third party is required. The requester will be notified of any such extension.
Remedies if a Request is Refused
If a request for access is refused, the requester may:
lodge a complaint with the Information Regulator, in the prescribed form and manner, within 180 days of the refusal;
apply to the Information Regulator for a review of the decision in terms of PAIA; or
apply to a court of competent jurisdiction for appropriate relief.
